Landlord Obligations

There are several legal obligations that a Landlord is required to meet at all times.

  • Energy Performance Certificate (EPC) – This is required for all rental properties being marketed to let, from 1st October 2008. Mundys have qualified Domestic Energy Assessors able to produce these certificates which can remain valid for ten years.

  • Tenancy Deposit Protection – This applies to all Assured Shorthold Tenancies (AST’s) in England and Wales where a deposit is taken. Under this legislation Landlords are required to join a statutory tenancy deposit scheme if they take deposits, meaning that deposits are safeguarded so that tenants will get all or part of their deposit back, if they have kept the property in good condition and entitled to get it back. There are two types of schemes that are available; custodial and insurance based schemes.

  • Taxation- as a Landlord you are required to pay tax on the income you receive, but the taxation level depends on whether you are classified as a UK resident or an overseas Landlord. If you are going to be living overseas whilst your property is let you will need to complete form ‘NRL 1’ prior to the property being let.   • Lender Consent- If the property is mortgaged, consent to the letting of your property must be obtained from your lender, to avoid a breach of your mortgage terms.

  • Compliance with Safety Regulations The following regulations must be adhered to before the property can be let:

    1. Gas Safety (Installation and Use) Regulations 1998 (as amended).
    2. Landlord and Tenant Act 1985
    3. The Electrical Equipment (Safety) Regulations 1994.
    4. The Furniture and Furnishings (Fire) (Safety) Regulations 1988.
    5. Consumer Protection Act 1987 and Housing Order 1997 - General Product Safety.
    6. Smoke Alarms- recommended that at least one is fitted to each floor of your property.
